Terms and Conditions

1. About us

This website (www.someno-ya.com) is owned and operated by YOUNEEDS Inc., Ltd. run by Waka Someno.

We hold the rights to change the terms and conditions as displayed on this website at any time without prior notice.

2. User Agreement

2.1 By placing an order with us, you automatically agree to our Terms and Conditions as listed on this page.

2.2 All sales are final and cannot be cancelled or altered once the payment for your order has been completed. If you made a mistake in the shipping or billing information, please let us know as soon as possible through the inquiry form. Once your order has been processed, we unfortunately are no longer able to make changes to your data.

2.3 Changes that need to be made after your order has been processed will be seen as a new order and are subject to additional handling costs.

3. Orders and Payments

Contract
3.1 When you place an order with us, you are making an offer to buy goods. After completion of the order, we will send you an email for confirmation.

3.2 In the unlikely event that the goods you purchased are no longer available, or that we have made a pricing mistake, we will advise you of this via email and there will be no contract between us.

3.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website.

3.4 We have made every effort to display colours of or products as accurately as possible. However, colours displayed on your monitor may slightly differ from the actual colours.

3.5  By placing an order with us, you agree to and accept the terms as written on this page, as well as our privacy policy.

 

Order Process

3.6 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

3.7 Shipping costs will be shown prior to you placing your order. As these prices are set by our carrier partners, they are subject to change. The rate displayed at checkout is the correct one and may vary from the rates shown on our Shipping and Returns page.

3.8 You are required to pay for the goods in full at the time of ordering.

3.9 We use secure payment facilities for online purchases. You can pay by Visa, Mastercard, American Express, UnionPay, JCB or Discover.

3.10 Promotional prices only apply during the period stated and may end earlier than the stated period depending on our stock.

3.11 All prices on our website are in Japanese Yen and include Value Added Tax at the current rate.

3.12 Once your order has been confirmed, as a rule it is not possible to make any changes as stated under 2.2. If changes are inevitable, these are only accepted at an additional charge which need to be covered by the buyer as stated under 2.3. The buyer also agrees to any delays in delivery when requesting alterations.

3.13 Once your order has been completed and shipped out, we will notify you via email. It is your responsibility to submit a valid email address when placing an order.

 

Customization Rules

3.14 Messages or names printed on the stamp cannot be longer than ○○ characters.
3.15 The size of the stamp, cover case, and ink color cannot be changed after your order has been placed. Alterations to the stamp design (images, name, message) cannot be made either.

3.16 If you selected the translation option, we will manually translate the name or message as assigned to you to Japanese. Please note that we will not share the design data with you before the stamp is produced and shipped to you. Therefore, revisions on the design are not possible, either.

3.17 We will not process orders when we are confident that the custom message:

- Encourages violence or abuse against groups or individuals

- Encourages hatred or harassment of private individuals or private groups (as opposed to public figures)

- Includes hate speech i.e., abusive, threatening, or demeaning words towards a certain race, religion, ethnicity, gender, disability, national origin, or sexual orientation

- Encourages animal abuse or cruelty, as typically defined by law

- Promotes, features, or encourages the use of hard drugs
- Promotes, features, or encourages underage drinking or smoking

Pricing

3.18 All prices mentioned on our webshop are the final sales price, taxes included as stated under 3.11. Additional costs such as custom duties may be charged additionally upon delivery and need to be covered by the buyer.

 

Payment Methods

3.19 All payments are processed through Stripe. Credit cards issued by the following companies can be used for payment: Visa, Mastercard, American Express, UnionPay, JCB, and Discover.

Currency

3.20 Our products are originally listed in Japanese Yen, but can be viewed in others currencies as well. Even when you select a different currency, you will still be billed in Japanese Yen at the time of checkout. The price your will be billed in your own currency is determined at the time of checkout, based on the exchange rate of that moment.

Billing time

3.21 Depending on your payment method, it may take some time before you see the transaction on your bank account. Please inquire your credit card company regarding the billing timing.

4. Shipping and Delivery

4.1 All orders are dispatched from our production site in Tokyo, Japan.
4.2 Shipping costs and time required for delivery depend on the selected shipping method and country of destination. For an overview of shipping methods, estimated time, and costs, see the Shipping and Returns page.

Lost or damaged packages

4.3 SOMENO-YA cannot be held responsible for lost packages or any damaged caused to your order after the parcel has left our production site. In the case of lost or damaged packages we advise you to directly contact the carrier in your country.

Delay in delivery

4.4 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, natural disasters, acts of god, war, riot, civil commotion, malicious damage, national holidays or the default of our suppliers. SOMENO-YA doesn't hold responsibility when delay or failure in delivering your goods is caused by any of the above.

5. Returns and Refunds

5.1 All sales are final and we do not accept returns.

Faulty Goods

5.2 If there is a problem with the goods, please notify us by email within 7 calendar days from the delivery day. You must provide us with a digital photograph of the problem as this saves you having to return the goods for inspection. A replacement will be sent after our teams has investigated the reported problem.

6. Liability

6.1 The products sold on this website have been designed to comply with all relevant Japan legislation. We cannot warrant or represent that they comply with any legal requirement outside Japan.

6.2 We do not accept liability for any consequential loss of profit or indirect losses.

Exclusion of liability

6.2 We take all reasonable steps to ensure that the information on this website is correct. However, we do not guarantee the correctness or completeness of material on this website. Neither we nor any other party (whether or not involved in producing, maintaining or delivering this website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss.
